Understanding Medicaid in New York and Upcoming Changes

For decades, New York residents seeking long-term care in their homes have reaped the benefits of one of the most generous Medicaid Home Care programs in the nation. Over the past few years, however, lawmakers and the Department of Health have implemented new rules that restrict eligibility.

An Important Window of Opportunity

Currently, there is no lookback for asset transfers when applying for Community Medicaid (Medicaid Home Care). This means there is now a window of opportunity for elder law attorneys to help families preserve life savings, complete a Medicaid application, and once accepted: long-term care services could typically begin in the home within a few months.

However, sometime in 2026, we expect new rules will impose a 30-month lookback period for transfer of assets of the Medicaid applicant in order to be eligible for Community Medicaid.
